1.1 Purpose
Winamax offers its Fixed-Odds Betting service in accordance with the Terms and Conditions, with these Regulations and with the applicable legislation, in particular Order EHA/3079/2011 of 8 November, which approves the basic regulations of fixed-odds sports betting.
Winamax advises that these regulations be read periodically and, in all cases, before participating in a new game.
1.2 Definitions
1. Other Fixed-Odds Bet This is the bet in which the participant bets against Winamax, obtaining the right to a prize in the case of a correct prediction, the prize being the result of multiplying the amount of the bet by the odds that Winamax has previously validated for the prediction made. The bet is placed on the outcome of one or more events included in the programmes previously established by Winamax, or on facts or circumstances forming part of or taking place within the framework of such events.
Selection. This refers to each of the bets that make up the bets offered under the Other Fixed-Odds Betting licence. In the case of single bets, these will contain only one selection. Accumulator bets or system bets contain more than one selection.
2. Event. An event related to society, the media, the economy, shows, culture or similar, previously determined by Winamax in the corresponding programme, which takes place in the context of a contest or outside of it, organised by persons, associations or entities independent of Winamax, and which has an uncertain outcome outside the control of the betting operator and the participants.
3. Betting odds or coefficient. The figure that determines the amount payable on a winning bet when multiplied by the amount wagered. Unless stipulated otherwise, the odds include the amount corresponding to the return of the amount initially paid by the winning bettor.
4. Suspended event. An event that, once started, has been interrupted before reaching its scheduled end (see section 6.3 of the Regulations).
5. Postponed event. An event that does not start at the scheduled start time (see section 6.3 of the Regulations).
6. Cancelled event. For the purposes of these Regulations, an event that does not take place or has been unscheduled (see section 6.3 of the Regulations).
Winamax will cancel any bet that does not comply with the instructions contained in this article and may suspend the payout of winnings for the duration of the investigation. If the suspicion is founded, the Website may impose sanctions against the participant in question in accordance with article 14 of the Terms and Conditions.
2.1 Betting on Behalf of a Third Party
All bets must be placed on a strictly personal basis. It is not permitted to place bets by impersonating another person. It is also prohibited to bet on behalf of a third party, whether in the exercise of a professional activity (bookmaker’s activity) or for any other reason (betting on behalf of a minor or a person not authorised to place bets).
2.2 Grouping of Participants
The participant undertakes to place his/her bets on a personal basis. Group betting (collective betting through a group of participants or betting syndicate) is prohibited. In case of suspicion of collective betting (bets on behalf of participants related to each other and/or placed within an abnormally short period of time, etc.), Winamax reserves the right to cancel the bet.
2.3 Betting with an Unfair Advantage
Winamax reserves the right to cancel any bets where the use of an unfair advantage by the participant is suspected, especially in the following cases:
- Where the outcome of the bet is known in advance to the participant at the time the bet is placed.
- Bets other than live bets placed after the actual start of the event (live bets refer to any bets that include the mention of the word “live”).
2.4 Interested Party Bets
Bets on events are prohibited in which the participant him/herself participates as:
a) A direct participant in any kind of game
b) The direct or indirect owner or direct or indirect manager of a club, game or broadcaster participating in the event or of any entity organising the event.
c) A judge or referee, or the person who decides appeals against decisions of such judge or referee.
Winamax reserves the right to cancel any bet placed by any of the persons listed above and to communicate all information relating to the bet, including the details of the account holder, to the organiser responsible for the sporting event concerned, to the authorities and to the Directorate General for the Regulation of Gambling (DGOJ).
2.5 Serial Betting
It is prohibited to place repeated bets containing the same selections in an attempt to exceed the betting limits defined by Winamax.
2.6 Bot-Assisted Gambling
The participant undertakes not to use bots or computer programs that permit automatic bets to be placed.
3.1 Confirmation of a Bet
The participant receives confirmation of having placed a bet in 2 ways:
- Immediately, on the Website, by means of the betting slip.
- In the “My Bets” section, accessible at any time from the Website.
3.2 Minimum Bet, Minimum Odds and Changes in Odds Prior to Bet Formalisation
Minimum Bet
The minimum amount that can be placed on each bet is €0.10.
Minimum Odds
The minimum odds or coefficient that can be set for a bet is 1.01.
Changes to the Odds Before the Bet is Formalised
The odds may vary from the time the participant makes selections and the time the bet is formalised. If, in the meantime, the odds go down, the new coefficient will be displayed to the participant, who will have the option to accept or reject it. If the odds go up, the bet will be automatically formalised at the new odds. Participants can deactivate this automatic formalisation option by modifying their sports betting options in the “My Personal Area” section of the Website.
3.3 Bet Modification
The participant cannot modify or cancel a bet after it has been formalised, except through the “Complete My Bet” function which allows new selections to be added to a previously formalised bet.
3.4 Betting Limits
Winamax reserves the right to set limits on the amounts wagered depending on the type of match or bet, the participant’s profile and his/her gaming behaviour, in accordance with article 21.2 of the Terms and Conditions.
Bets in excess of these limits will not be accepted and the participant will be informed immediately that his/her bet has not been accepted.
In addition, Winamax will not accept any bet with potential net winnings of more than €550,000. That is, the maximum winnings limit per bet in any case will be 550,000. The net winnings from a bet is equal to the winnings from the bet minus the amount wagered. This limit applies equally to any combination of bets placed on combined or partially combined selections by a participant.
The specific regulations of a promotion run by Winamax may authorise winnings in excess of €550,000.
As a general rule, the amount of money that a single participant may spend on his/her participation in other live fixed-odds betting may not exceed the amount of the balance the participant has in his/her gaming account at the moment the event on which the bets are to be placed begins.
In cases where the participant registers as a Winamax user after the start of the event on which bets are to be placed, it shall be understood, for the purposes of the provisions of the previous paragraph, that the amount of the freely available balance of the gaming account is zero.
If, during the course of the event on which bets are being placed, the participant obtains an additional amount in his/her gaming account, exclusively from the prizes won as a result of live bets placed on that sporting event, this deposited amount may also be used to place new live bets on that same event.
In the event that the same participant places live fixed-odds bets on two or more events taking place simultaneously, the limit on the amounts the participant may place bets on shall be the amount of the balance the participant has in his/her gaming account at any given time, as a result of the provisions of the two preceding paragraphs.
3.5 Responsible Gambling
Each participant personally sets the maximum ceiling of his/her betting limits as well as the deposit limits of his/her gaming account in accordance with article 13 of the Terms and Conditions. No bets in excess of these limits will be accepted.
3.6 Error in the Publication of a Result
Winamax reserves the right to correct with retroactive effect any errors in the publication of results and, where applicable, may cancel the affected bets and recover any winnings paid out in error to the participant.
3.7 Information Services
Winamax makes every effort to ensure that the information services provided on the Website are correct (statistics and results are displayed before and during the sporting event). However, this information is purely indicative and errors may occur. It is the participant’s responsibility to ensure that he/she is in a position to monitor the progress of the event and to consult official sources of information in order to be sure of the score, the team’s ranking or any other result before or during the event prior to placing the bet.
4.1 Bet Before an Event
This type of bet is offered exclusively before the start of an event.
4.2 Live Bet
This type of bet is offered exclusively during certain events. The odds of this type of bet are updated permanently and in real time, and may vary between the time the participant makes the selection and the time the bet is formalised. In case the odds have dropped in the meantime, the new coefficient will be shown to the participant, who will have the option to accept or reject it.
4.3 Free Bet
Winamax may offer free bets to participants. Free bets will only expire if the participant reaches a period of 6 months of inactivity in his/her account.
When the participant wins a free bet, he/she only receives the net winnings, which are equal to the “free bet amount x (odds-1)”.
For example, if the participant uses a €5 free bet on a bet at odds of 3.00, and the bet is a winner, the net winnings are €10.
4.4 Bet on the Outcome of a Competition or Season
Bets on the outcome of a competition or a season are more or less long-term bets that can last several months, or even several years. They are based on the outcomes(s) of one or more competitions and are therefore dependent on the performance of the selection associated with the bet during that competition, tournament, season, etc.
This type of bet can be placed on the basis of an outcome (winner, podium, elimination, ranking, etc.), but also on the basis of a points ranking.
The bet will be declared a losing bet if the selection associated with the bet does not participate in the competition as a result of non-qualification, sanction or suspension, or if the same selection withdraws or is disqualified during the competition. For any type of abandonment other than those mentioned above, the bet will be cancelled.
5.1 Single Bet
A single bet consists of a single selection or prediction on a sporting event (winner, exact result, etc.). If the bet is correct, the participant receives a prize equal to the multiplication of the amount wagered by the current odds at the time the bet was formalised.
5.2 Accumulator Bet
An accumulator or multiple bet is composed of several single bet selections, the odds of which are multiplied together to establish the overall odds. If the participant gets all the selections right, he/she receives a prize equal to the multiplication of the amount wagered by the overall odds set at the time the bet was formalised.
The participant loses the bet if one of the selections loses.
Cancelled selections of an accumulator bet (see article 6 which provides for cancellation cases) are deemed to be winners at odds of 1.00. The cancellation of any of the selections that make up an accumulator bet means that the overall odds will be readjusted in accordance with the new odds of the cancelled selection pursuant to the above indication.
The selections comprising an accumulator bet must be independent of each other, i.e., the outcome of one selection must not be able to influence the outcome of the other selections in the accumulator bet. For example, it is not possible to combine selections relating to the same football match.
5.3 System Bet
A system bet allows the participant to place multiple accumulator bets at the same time. This is a complex version of the accumulator bet.
System bets follow the P/N ratio, where “P” is the number of selections for each accumulator bet and “N” is the total number of individual selections.
For example, if we start with 4 individual selections (A, B, C, D), “N” would be equal to 4. Depending on the number of selections in each of the accumulator bets that will make up the system bet, “P” could be equal to 2 (2/4 system resulting in 6 accumulator bets; AB, AC, AD, BC, BD, CD) or 3 (3/4 system resulting in 4 accumulator bets: ABC, ABD, ACD, BCD).
The following formula is used to determine the price of a system bet and the number of combination bets that make up a system bet:
N!/(P! x (N-P)!). The product of this formula would be the number of accumulator bets that make up the system bet and must be multiplied by the amount of the single bet chosen by the participant to obtain the price of the system bet.
For example, the price of a 2/4 system bet (6 accumulator bets) will be €6 if the selected unit bet is €1.
In system bets, the amount of winnings is equal to the sum of the winnings from each of the winning accumulator bets that make up the system bet. Each of these winnings is in turn the product of multiplying the overall odds of each accumulator bet by the amount of the unit bet chosen by the participant.
The selections that make up a system bet must necessarily be independent of each other, i.e., the outcome of one selection must not be able to influence the outcome of the other selections in the system bet. For example, it is not possible to combine selections relating to the same event in a system bet.
6.1 Prohibited Bets
Winamax may cancel any bet that is prohibited in accordance with article 2 of these Regulations, without prejudice to the actions referred to in article 14 of the Terms and Conditions.
6.2 Late Bets
Winamax will cancel any bets that may have been placed (for whatever reason) after the start of the event on which the bet is placed.
This rule shall not apply to live bets, differentiated by the “Live” sign.
Winamax will also cancel any bets that may have been placed (for whatever reason) after the end of the phase of play or event to which it relates.
6.3 Cancelled, Suspended or Postponed Events
Bets are void in the following cases:
- If the event is cancelled (see article 1.2).
- If the event is postponed or suspended (see article 1.2), and the event does not start or does not resume within 48 hours of the scheduled start date when the bet was formalised. This rule does not apply if the actual date of the sporting event is not known at the time the bet is formalised.
6.4 Non-Independent Selections in an Accumulator or System Bet
Winamax will cancel accumulator bets or system bets that are composed of selections that are not independent of each other (i.e., where the outcome of one selection can influence the outcome of the other selections), in accordance with the rules applicable to each type of bet as set out in Article 5 of these Regulations.
6.5 Theoretical Rate of Return Above 100%
Winamax will cancel any bet placed which has a theoretical rate of return above 100% for all possible selections at the time the bet was placed. In addition, this condition also applies to a group of selections when there is necessarily a winning result between these selections. For example, if the “winner of the match” bet involves 2 selections, and each of them has odds of 3, the theoretical rate of return would be 150%, which would correspond to a rate of return higher than 100%.
The theoretical rate of return is calculated as follows: 1/((1/selection odds 1)+(1/selection odds 2)+...+(1/selection odds n)). The loyalty programme is included in this rate of return, assuming a value of €0.015 per mile.
6.6 Integrity of an Event
Winamax will suspend or cancel any bet placed on an event regarding which its suspects a lack of integrity.
Winamax undertakes to report such suspicions to the competent authorities through the channels provided for this purpose.
6.7 Error in the Bet Title or Description
Winamax staff work hard every day to ensure there are no errors in bet titles. However, if as a result of human, computer or technological error, the title of a bet is incorrect, for example, because it is misleading or does not correspond to the odds to which it is associated, Winamax will inform the participant concerned of the existence of the error in the bet title as soon as it becomes aware of it, and in any case, before the start of the event on which the bet is placed, cancelling the bet and proceeding as provided in section 6.8.
6.8 Manifest Error in the Odds.
Winamax staff work hard every day to ensure that there are no errors in the taking of bets. However, if as a result of human, computer or technological error the odds of a bet are affected by a manifest error, Winamax will inform the participant concerned of the existence of the said error as soon as it becomes aware of its existence, and in any case before the start of the event on which the bet is placed, and it will proceed to cancel the bet.
Such an error shall be deemed to exist when the odds are manifestly higher or lower than they should have been according to the risk assumed by the customer in such bet, taking into account the probability of the predicted outcome, and when such odds are substantially higher or lower than the odds offered for the same market by other national operators.
6.9 Consequences of Bet Cancellation What Happens when a Bet is Cancelled?
In the event of a cancellation, a bet will be deemed a winner at odds of 1.00. Therefore, the amount wagered will be refunded to the participant.
In the case of accumulator bets, if one of the selections making up the bet is cancelled, the cancelled selection will be deemed the winner at odds of 1.00. The cancellation of any of the selections that make up an accumulator bet, involves the readjustment of the overall odds in accordance with the new odds of the cancelled selection established pursuant to the above indication.
Start dates and times are shown for information purposes and may be subject to change, if an event is cancelled, postponed or interrupted and is not resumed within 48 hours of the originally scheduled start time, bets will be void. Games or maps that are completed within the 48-hour deadline will be settled normally.
If an event starts before its scheduled time, then all bets placed after the start of the event will be cancelled. Bets placed before the start of the event will stand.
Bets are void if the established number of maps changes, or differs from that which has been offered for the purpose of the bet. In an event where matches have started but are not completed, bets will be considered void unless the outcome is already determined and unchangeable.
